JUSTICE BEYOND REACH: THE FINANCIAL BARRIERS TO ACCESSING JUSTICE IN NIGERIA
This article examines the critical gap between the legal right to justice and the financial reality of enforcing it in Nigeria. While the 1999 Constitution and the Legal Aid Act of 2011 establish frameworks to ensure legal redress and assistance, high litigation costs, filing fees, and professional representation remain prohibitive for low-income individuals. Furthermore, the Legal Aid Act’s restrictive eligibility threshold, primarily limited to those earning below the national minimum wage, leaves many vulnerable citizens without recourse. To bridge this gap, the article recommends reviewing the legal aid eligibility criteria to reflect current economic realities, increasing funding for legal aid, promoting pro bono and community legal initiatives, and simplifying court procedures to ensure justice in Nigeria is a universal right rather than a financial privilege.
